Terms and License Agreement
This Terms and License Agreement (“Agreement”) is entered into between TheBitCraft, a software development agency (“TheBitCraft”), and the user (“User”) of TheBitCraft’s software products and services (“Services”).
By accessing or using TheBitCraft’s Services, the User agrees to be bound by the terms and conditions of this Agreement. If the User does not agree to these terms, the User may not access or use the Services.
License Grant
Subject to the terms of this Agreement, TheBitCraft grants User a non-exclusive, nontransferable, limited license to use the software products provided by TheBitCraft solely for User’s internal business purposes.
- Have a website or platform relevant to our industry (e.g., technology, software development, web design).
- Demonstrate a genuine interest in promoting our services and maintaining a positive brand image.
- Adhere to ethical business practices and comply with our terms and conditions.
Restrictions
User shall not:
- Modify, adapt, alter, translate, or create derivative works of the software products.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the software products.
- Remove, alter, or obscure any proprietary notices or labels on the software products.
- Use the software products for any unlawful purpose or in violation of any applicable laws or regulations.
- Use the software products to infringe upon the intellectual property rights of TheBitCraft or any third party.
Ownership
TheBitCraft retains all right, title, and interest in and to the software products, including all intellectual property rights therein. This Agreement does not convey to User any ownership interest in the software products, but only a limited right to use as expressly set forth herein.
Support and Maintenance
TheBitCraft may, at its sole discretion, provide support and maintenance services for the software products. Any such services shall be subject to additional fees and terms as mutually agreed upon by the parties.
Termination
This Agreement shall remain in effect until terminated by either party. TheBitCraft may terminate this Agreement immediately upon written notice to User if User breaches any provision of this Agreement. Upon termination, the User shall immediately cease all use of the software products and return or destroy all copies thereof to the User’s possession or control.
Limitation of Liability
In no event shall TheBitCraft be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the software products, even if TheBitCraft has been advised of the possibility of such damages.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without giving effect to any choice of law or conflict of law provisions.
Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.
Modifications
TheBitCraft reserves the right to modify this Agreement at any time by providing notice to the User or by posting the revised Agreement on its website. User’s continued use of the software products after such modifications shall constitute User’s acceptance of the revised Agreement.
